The way a contingency fee works is, all contingency fee plaintiff lawyers, like myself, get paid the same way. It is by a contingency fee contract based on usually a 40% fee if the case is filed and in litigation. That may sound like a lot, but you have to remember that it has been set up this way because we get zero if there is no recovery. It doesn’t matter if we spent $200,000 litigating the case and five years of our lives. If we are wrong, if the experts are wrong, we get zero. The client doesn’t owe us anything, and we still have to pay all the bills. Whether you hire a lawyer that’s right out of law school or whether you hire someone like me that has been licensed since 1984, you’re going to pay the same fee. What a lot of people don’t understand is that makes the client on the same page as his or her lawyer. This is because the lawyer’s fee is based on the recovery. The reason it is fashioned in this way is so the lawyer should want to get best recovery for the client so that they get the most money.
